The law on public enterprises does not allow anyone to serve as an acting director for more than a year, and Milorad Grčić has been performing the duty at state power utility Elektroprivreda Srbije (EPS) for over four years.

The State Audit Institution (DRI) has published a report on the EPS in which it states that the top management of this state company – acting director Milorad Grčić and the entire Supervisory Board, headed by Branko Kovačević – are holding these positions against the law, as well as that their terms have expired.

Grčić was appointed acting director in March 2016, and the law allows an acting director to serve only a year

The same appointed person (Milorad Grčić) has been the acting director of EPS for more than four years, which is not in accordance with Article 52, paragraph 2 of the law on public enterprises, which stipulates that an acting director cannot serve longer than a year, according to the report on an audit of EPS’ operations.

Grčić was appointed acting director by a decision of the Government of Serbia on March 15, 2016. According to the State Audit Institution, his term of office as acting director in line with this decision has expired.

The Supervisory Board, headed by BrankoKovačević, was elected in 2014, and its term expired in 2018

As for the Supervisory Board, the chairman and members were appointed by a decision of the Government of Serbia on November 20, 2014, and their term expired on November 20, 2018, but they continued to perform these duties in 2019, which was in violation of article 21 of the law on public enterprises.

The chairman and members of the Supervisory Board are still holding these posts. The members of the board are Aleksandar Trifunović, Aleksandar Gajić, Branislav Marković, and Zoran Lazarević.

EPS to ask the Government of Serbia to rectify the violations of the law

The State Audit Institution also recommended how to rectify these violations of the law.

It recommends to EPS to ask its founder (the Government of Serbia) to appoint a director, as well as a chairman and members of the Supervisory Board, in accordance with the law on public enterprises, the report reads.
